Terms of Service
1. Agreement
These terms govern your use of ViralForge at https://viral-forge.hs-apps.cloud (the "Service"), operated by Stephen Maina ("we", "us"). By using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
ViralForge helps creators discover trending topics, draft content with the help of artificial intelligence, review it, and publish approved content to connected Facebook Pages, Instagram professional accounts, YouTube channels and TikTok accounts. Access is limited to people we have given an account. There is no public sign-up.
3. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at stephenmaina02@gmail.com if you suspect unauthorised use.
4. Connected platforms
When you connect a social account, you authorise the Service to access it and publish on your behalf within the permissions you grant. You must have the right to manage every account you connect, and you remain bound by each platform's terms, including the Meta Terms of Service, Instagram Terms of Use, YouTube Terms of Service and TikTok Terms of Service. By using the Service's YouTube features, you agree to be bound by the YouTube Terms of Service.
You can disconnect an account at any time from the Service, or remove the Service's access in the platform's settings.
5. Review and approval
Nothing is published through the Service unless an authorised reviewer approves it, and approval applies to the exact version reviewed. You are responsible for the content you approve, including its accuracy, its compliance with law and platform policies, and any required disclosures such as sponsorship or AI-generated content labels.
6. AI-generated content
Drafts are produced with third-party AI models and may be inaccurate, incomplete or similar to other material. Review every draft carefully before approving it. We make no guarantee that generated content is accurate, original or fit for any purpose.
7. Your content
You keep all rights you have in content you create or approve through the Service. You grant us a limited licence to host, process, store and transmit that content only as needed to provide the Service to you. Stock footage is supplied under the licences of its providers, such as Pexels and Pixabay.
8. Acceptable use
You agree not to use the Service to:
- publish content that is unlawful, infringing, deceptive, defamatory, hateful, harassing or sexually explicit;
- send spam, manipulate engagement, or otherwise break the rules of any connected platform;
- impersonate others or misrepresent who is behind an account;
- access accounts or data you are not authorised to use; or
- interfere with, probe or overload the Service or its providers.
We may suspend access that breaks these rules.
9. Third-party services
The Service depends on platforms and providers we do not control. Their features, policies, availability and approval decisions may change or limit what the Service can do, and we are not responsible for their actions.
10. No guarantee of results
Performance figures and monetisation eligibility estimates are informational only. We do not guarantee reach, followers, eligibility for any creator programme, or earnings.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, accounts or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.
13. Ending your use
You may stop using the Service at any time. We may suspend or end access if you break these terms or if we discontinue the Service. After access ends, we handle your data as described in the Privacy Policy.
14. Changes to these terms
We may update these terms and will change the effective date above when we do. Continuing to use the Service after a change means you accept the updated terms.
15. Governing law
These terms are governed by the laws of Kenya, without regard to conflict of law rules.
